Terms of Service

Welcome to the Minimal Pairs Pro app. These Terms of Service ("Terms") govern your access to and use of the Minimal Pairs Pro app ("App") provided by Utter Success Lab, LLC ("Company," "we," "us," or "our"). Please read these Terms carefully before using the App.

By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

By downloading, installing, or using the Minimal Pairs Pro app, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you are using the App on behalf of a child, you represent that you are the parent or legal guardian of the child and consent to these Terms on their behalf.

The Minimal Pairs Pro app is an educational speech therapy application designed to help users practice and improve their speech and pronunciation skills through interactive exercises. The App provides:

• Interactive minimal pairs exercises for speech practice
• Text-to-speech functionality for audio feedback
• Progress tracking and exercise history
• Customizable settings for personalized learning

The App is designed for use by individuals of all ages, including children. However:

• Children under 13 years of age must have parental consent and supervision when using the App.
• Parents and guardians are responsible for monitoring their children's use of the App.
• We comply with the Children's Online Privacy Protection Act (COPPA) and do not knowingly collect personal information from children under 13 without verifiable parental consent.

The App offers optional user accounts, which you can create using an email address or a third-party sign-in provider (such as Google or Apple). By using the App, you understand and agree that:

• If you create an account, your settings, progress, and subscription status are stored in the cloud so they can sync across your devices; if you use the App without an account, this data may be stored only on your device.
• Uninstalling the App or clearing app data may result in loss of any progress that is stored only on your device.
• Our collection and use of your personal information is described in our Privacy Policy.

The App is free to download and includes premium features available through a paid subscription, offered with a 7-day free trial. The following terms apply to subscriptions:

• Billing. Subscriptions purchased on iOS are billed through your Apple App Store account and on Android through your Google Play account; subscriptions purchased on the web are billed through our payment processor, Stripe.
• Free trial. The 7-day free trial is limited to one per user. Unless you cancel before the trial ends, it automatically converts to a paid subscription and the applicable fee is charged.
• Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
• Cancellation. You can cancel at any time. Subscriptions purchased through the App Store or Google Play must be cancelled in your Apple or Google account settings; web subscriptions can be cancelled from your account or by contacting us. Cancellation stops future renewals, and you retain access until the end of the paid period.
• Refunds. Except where required by law, payments are non-refundable. Refund requests for purchases made through the App Store or Google Play are handled under Apple's or Google's refund policies; for web purchases, contact us at SLP@uttersuccess.com.
• Deleting your account does not cancel a store subscription. Deleting your in-app account does not automatically cancel a subscription purchased through the App Store or Google Play, and does not by itself stop future charges. To stop billing, you must cancel the subscription in your Apple or Google account settings.

You agree to use the App only for its intended educational and therapeutic purposes. You agree not to:

• Modify, reverse engineer, decompile, or disassemble the App.
• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to the App's systems or networks.
• Distribute, sublicense, or transfer the App to any third party.
• Remove or alter any proprietary notices, labels, or marks on the App.

The App and all its content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, and software) are owned by Utter Success Lab, LLC and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

The App may utilize third-party services for certain functionality, including:

• Text-to-speech engines provided by your device's operating system.
• Web fonts and styling resources.
• Cloud, authentication, and database services (e.g., Google Firebase) used to provide accounts and sync your data.
• Payment and subscription-management services (e.g., the Apple App Store, Google Play, Stripe, and RevenueCat) used to process purchases and manage subscriptions.

Your use of these third-party services is subject to their respective terms and privacy policies.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• The results obtained from using the App will be accurate or reliable.
• The App will meet your specific therapeutic or educational needs.

Important: The App is intended as a supplementary educational tool and is not a substitute for professional speech therapy services. Always consult with a qualified speech-language pathologist for personalized treatment.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UTTER SUCCESS LAB, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any bugs, viruses, or other harmful code that may be transmitted through the App.
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, transmitted, or otherwise made available through the App.

You agree to indemnify, defend, and hold harmless Utter Success Lab, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time without notice. We also reserve the right to update these Terms at any time.

Your continued use of the App after any modifications to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Utter Success Lab, LLC operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Utter Success Lab, LLC regarding your use of the App and supersede any prior agreements between you and Utter Success Lab, LLC relating to your use of the App.
